Kim Kardashian may want this marriage to Kris Humphries to be over but she does not want to ‘battle’ him in court! Kim originally wanted an annulment too, but changed her mind when she thought she needed more proof for an annulment and then opted for the divorce!
According to People,
“The filing is, of course, upsetting,” says the source, who is close to the reality starlet. “She respects Kris and just wants them both to find peace and move on. … Kim doesn’t want a battle.”
The NBA player went to court Wednesday with a request to annul their 72-day marriage on the grounds of fraud. If granted, it would be legally tantamount to the elaborate, filmed-for-TV wedding having never taken place.
Kardashian originally had looked into filing an annulment, says the source, but opted instead for a divorce petition because she was told it would be too difficult to prove the grounds for an annulment in court.
“Kim is sad how things ended up,” says the source. “The split was a devastating decision from the beginning.”
Kim also need to be careful…with an annulment Kris could try to overturn the Prenup! Allegedly Kris want to be able to talk about the marriage so he wants the prenup overturned, but there is no word if he will go after the millions!

The NBA star formally filed a response Thursday in the divorce proceedings that Kardashian initiated after only 72 days of marriage. Humphries wants the marriage annulled on the grounds of “fraud.â€
It’s a brilliant strategic move because by seeking to have the marriage annulled, Humphries can request that the prenup be tossed, primarily so he won’t be muzzled by the confidentiality agreement.
“The confidentiality aspect of the prenup is extensive and was created just in case things went bad, neither Kim nor Kris could discuss their relationship to the media. But now, Kris wants to be able to talk about the relationship without fear of being sued,” a source close to the situation tells RadarOnline.com.
If the judge does ultimately annul the marriage because of fraud, it’s very likely that the prenup would be tossed because under California law, Kardashian and Humphries were never legally married.
“Kris is getting excellent legal advice. If the judge annuls the marriage, they were never legally married, and the prenup at that point is really moot. Kris wants this to play out in court, and wants the process to be transparent. If this needs to go to trial, he is ready for that,” the insider says.
Our sources tell us: “the gloves are off, Kris won’t be a doormat anymore.”
