‘Shahs of Sunset’ star Asa Rahmati has been in the process of starting her own water bottle company, Diamond Water, but the company was just slapped with a trademark lawsuit by Gastroceuticals, LLC in October 2013. According to Radar, the company is demanding a jury trial and and claim they own the trademark to “Dymund” and Rahmat’s Diamond Water name appears too similar. They feel the names are too similar and will cause confusion an d hurt their brand.
Gastroceuticals, LLC wants an unspecified amount in damages, but also attorney’s fees, punitive damages, costs of the suit so far. Rahmati shot back with her own statement denying any trademark infringement.“Diamond Water generally denies any and all allegations, speculation, factual assertions, and claims for relief made by Plaintiff in its complaint except those expressly admitted below.”
Rahmati says she owns trademarks for both Diamond Water and Asa’s Diamond Water adding that the “Dymund” is not yet established so there should be no confusion between the two companies.Diamond Water wants the lawsuit dropped and their legal bills to be paid for by Gastroceuticals, LLC.
