Bruce Jenner was smoking not texting as previously reported during yesterday’s accident that claimed the life of one person and injured several others. At first it was believed Jenner may have been texting during the car crash on the Pacific Coast Highway in Malibu. According to TMZ, L.A. County Sheriff’s Dept. will get a search warrant to gain access to Jenner’s phone records to determine if he was texting at the time of the accident in which he rear ended a white Lexus, pushing that car into an intersection with on-coming traffic and the Lexus was struck by a Hummer. If he was using the phone he could be charged with vehicular manslaughter. (Update…Sgt. Philip Brooks  says no such warrant was issued).

But Jenner seemed to be smoking at the time of the accident, not texting as previously thought. It’s still unclear what caused the accident but it seems Jenner tried to avoid the crash since there are skid marks from his car very visible on the floor. And the paparazzi may not be to blame either as originally thought. “Mr. Jenner was aware that the paparazzi were following him and he wasn’t taking any evasive actions,” Sgt. Philip Brooks told People. “There was no evidence of paparazzi driving inappropriately.” The paparazzi were actually across the street from Jenner and the accident.

According to People, “The authorities are still investigating what caused the accident, but Sgt. Brooks told PEOPLE that the chain of events started when a Prius two cars in front of Jenner’s Escalade came to a stop for unknown reasons. A white Lexus in front of Jenner’s car then hit the Prius before Jenner crashed into the Lexus. The Lexus then drifted into oncoming traffic, colliding with a black Hummer. The 70-year-old woman driving the Lexus was pronounced dead on the scene, Sgt. Brooks said.”

So it might be the Prius’ fault?
