Kelly Rutherford;s children will finally return to the United States. After an extensive and expensive custody battle with her former husband, Daniel Giersch. For the past three years, Rutherford has been fighting court battle after court battle to try and bring her children home to the US after her ex was awarded custody and his US visa was revoked due to alleged illegal activity.
Rutherford has finally been given sole legal and physical custody of her two children temporarily by a California judge according to People. Rutherford’s two children, son Hermes, 8, and daughter Helena, 5 (6 next month) will return to the US from Monoco where they had been living with their father since 2012.
“We are ecstatic, and hopeful that Monaco will respect the California court’s ruling and send the children home. It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country,” Rutherford’s lawyer Wendy Murphy told People. “If the citizenship shoe were on the other foot and these children were citizens of Monaco, I have no doubt the United States would respect their right to reside in Monaco.
“Monaco officials know that sending the children back to America is the right thing to do. I’m looking forward to the happy reunion of the children not only with their mother, but also with their country!”
According to Rutheforns Giersch denied access to the children when she landed in France to see them until she handed over their passports. She claims he said they would use a neutral person, but she says it was really one of his attorneys.
Kelly recently got a little help from a few famous friends who joined in on her petition to the White House for help after a federal court denied her request for the children to be returned to the US.
