Tom Cruise and wife Katie Holmes have called a truce for now while their lawyers hash out a settlement, they may not be heading to court unless they are not able to come up with a settlement via custody, child support and properties. So far everything is said to be ‘calm.’

Sources very familiar with the situation tell us … there are NO immediate plans for either side to go to court. There will be no court hearing Monday, Tuesday or in the foreseeable future, unless the negotiations fall apart.
Sources tell us the lawyers are negotiating child custody, visitation, child support and a property settlement.
We’re also told the whole settlement could be ratified in New York if all goes well. In other words, there may not be a move by Tom’s camp to transfer the case to California, where judges are more likely to award joint custody.
One source described the emotional state of the negotiations as “calm.”
On Friday Katie was seen heading to her divorce lawyers office, Aronson, Mayefsky and Sloan in NYC. She arrived with four bodyguards in a Mercedes with black tinted windows, Suri did not join her.
PEOPLE has learned that for the past few days, lawyers for Tom Cruise and Katie Holmes have been working to negotiate an agreement between the two stars to avoid a brutal public divorce battle. “Neither one of them wants this to be hashed out in public,” says a source.
